  • Lies are not "Puffery"

    Why is it that every time a business seeks to back away from affirmative claims it makes about its products/services, it cries "puffery"? (Rhetorical question . . . ) As a user of Yelp who has been told -- by Yelp -- that certain of my reviews were pulled because Yelp determined I had not actually had the experience I claimed (or that an actual picture was not "representative" (whatever that means), I think this decision is spot on. Will be interested to see what kind of evidence discovery yields. I‘m willing to bet the email discussions are fabulous. Hope the lawyers fight Yelp‘s effort to subject everything to a protective order. Deception is not a trade secret . . .
